Rep. Mann Pushes Back on President Biden's Veto of WOTUS Legislation


WASHINGTON, D.C. – On April 19, 2023, U.S. Representative Tracey Mann (KS-01) voted in favor of overriding President Biden’s veto of H.J. Res 27, a resolution under the Congressional Review Act to demand a review of President Biden’s Waters of the U.S. (WOTUS) rule, which removes longstanding bipartisan exemptions for common water features like ponds and streams found on private property.   

“Congress has spoken clearly on this issue,” said Rep. Mann. “President Biden received a bipartisan joint resolution of disapproval on his administration’s flawed and burdensome “Waters of the United States” (WOTUS) rule. He vetoed it – that is inexplicable. Congress, not the Executive Branch, was created to legislate, and this veto is unacceptable. While President Biden would like to federally regulate every small stream, ditch, and puddle from sea to shining sea, American producers have been the careful custodians of their own resources for centuries. They are the original conservationists, and their livelihoods already depend on their voluntary efforts to care for their water resources. With my vote to override this veto, I am standing up not only for the people who feed, fuel, and clothe us all but also for all Americans whose businesses and private lives would be affected by this big government encroachment onto their private property.”  

Background

On March 9, 2023, the U.S. House of Representatives passed H.J. Res 27 by a vote of 227-198. 

On March 29, 2023, the Senate passed H.J. Res 27 by a vote of 53-43.  

On April 6, 2023, President Biden vetoed H.J. Res 27.   

On April 18, the U.S. House of Representatives failed to reach the required 2/3 majority to override the veto.

The U.S. Supreme Court has not yet issued its ruling on Sackett v. EPA, which would determine the legality of President Biden’s WOTUS rule.
